1. Data Accuracy and Reliability

• No Absolute Accuracy Guarantee: While Capto strives to provide accurate coordinate identification and drawing tools, we do not guarantee the absolute accuracy, completeness, or reliability of the data presented or created. Coordinates are derived from various geodata sources, including OpenStreetMap, which may contain errors, omissions, or variations.
• Not for Critical Use: This application is not intended for use in critical applications where precise and verified data is essential, such as professional surveying, precise navigation, legal boundaries, emergency services, or any scenario where inaccuracies could lead to harm or significant loss.
• Dependence on External Sources: The accuracy, availability, and presentation of maps and geodata are dependent on external sources (e.g., OpenStreetMap). Capto is not responsible for any interruptions, inaccuracies, or errors originating from these third-party data providers.
• Address Search Results: The address search feature is powered by a third-party geocoding service (Nominatim, provided by the OpenStreetMap Foundation). Search results may be ambiguous, incomplete, outdated, or incorrect (for example, multiple unrelated places sharing the same name). You are responsible for verifying that a selected result corresponds to the location you intend before relying on it.

2. User Responsibility

• Use at Your Own Risk: Your use of Capto is solely at your own risk. You assume full responsibility for any reliance placed on the information obtained through the application.
• Verification of Data: Users are strongly advised to independently verify any coordinate data obtained from Capto using alternative, certified methods or sources, especially when accuracy is paramount.
• Compliance with Laws: You are responsible for ensuring that your use of the application and any data obtained therefrom complies with all applicable local, national, and international laws and regulations related to geographical data, privacy, and geospatial data creation.

3. Data Persistence (Browser Memory)

• Local Storage Only: The option to persist your features (points, lines, polygons, and their custom properties) is implemented by storing data exclusively in your web browser's local storage. This means the data resides only on your device and within that specific browser.
• No Guaranteed Backup: This local storage mechanism is not a cloud storage service or a guaranteed backup solution. Data may be lost if you clear your browser's cache, use a different device or browser, or if there is a browser malfunction. Capto is not responsible for any loss of locally stored data.
• Data Privacy: Data stored in your browser's local memory is not transmitted to or stored on Capto servers. This information remains private to your browser instance.
• Address Search Queries: Capto has no backend server. When you use the address search feature, the text you enter is sent directly from your browser to the third-party geocoding service (Nominatim) described in Section 4 — it does not pass through or get stored by Capto. That transmission is subject to Nominatim's/OpenStreetMap Foundation's own privacy practices, not ours.

4. Intellectual Property and Use of Materials

• OpenLayers and OpenStreetMap: Capto utilizes the OpenLayers library for map visualization and relies on OpenStreetMap for geodata. We acknowledge and respect their respective licenses and terms of use. For more information, please refer to the OpenLayers Code License and the OpenStreetMap Copyright and License (ODbL).
• Nominatim (Address Search): The address search feature uses Nominatim, a free geocoding service operated by the OpenStreetMap Foundation. Use of this feature is subject to Nominatim's usage policy. Capto is not responsible for the availability, accuracy, or performance of this third-party service.
• No Endorsement Implied: The use of these third-party technologies and data sources does not imply endorsement, affiliation, or partnership with Capto.

5. General Limitation of Liability

• "As Is" and "As Available": Capto is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Service Availability: We do not guarantee that the application will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to modify, suspend, or discontinue the service (or any part thereof) at any time, with or without notice.
• Exclusion of Damages: In no event shall Capto or its creators be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; or (iii) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
